The partner of a woman who died after being locked in a car and set on fire is unfit to stand trial, a court has ruled.
Kevin Marks, also known as Kevin McFaulds, was accused of murdering Ann Dummond near Drumcross Farm in Bathgate last June.
But a judge ruled he won’t go on trial after receiving psychiatric reports.
Marks, 47, allegedly parked his car in a way that prevented Ms Drummond from getting out, before hitting her with a brick, pouring petrol on her and setting the car alight.
The 47-year-old mum died two days later at Edinburgh’s Royal Infirmary.
On Wednesday at the High Court in Glasgow, defence QC Shelagh McCall said: “Mr Marks is unfit for trial and unfit to tender a plea. He is currently subject to a treatment order at the State Hospital.”
Judge Lady Stacey told him: “Mr Marks, we won’t have a trial due to your condition. Instead we will have an examination of facts.”
That will take place at the High Court in Edinburgh on August 24.
Lady Stacey ordered Marks to remain at the State Hospital for treatment.
