A man went into “fight or flight” mode after seeing three people armed with “hammers or machetes” smash the windows of his girlfriend’s car, a court has heard. 

The man said he told Amy Rose Wilson that they needed to leave Foundry Street in Falkirk, after her car came under attack on July 29, 2023. 

Amy Rose’s boyfriend told the High Court in Edinburgh that the couple had dropped off their friend before a Mercedes car then pulled up behind them, and three masked people got out. 

The Crown claims that Amy Rose and her boyfriend were in possession of “controlled drugs and money” on the day that the witness was speaking about. 

Crown lawyers claim three men – Arslan Sajid, 24, Andrew Gregoire, 29, and Anthony Davidson, 32 – assaulted Amy Rose and her boyfriend in an attempt to rob them of “a quantity of controlled drugs and money”.

The prosecution also claims the three men murdered Amy Rose and attempted to murder her boyfriend by causing the car they were allegedly travelling in to strike the couple’s vehicle after they had left Foundry Street.

This allegedly caused a collision between Amy Rose’s car and another vehicle, which led to her death. 

On Tuesday, her boyfriend told prosecution lawyer Alan Cameron KC that he and his friend were talking in the street when the attack started. 

He told his friend that the three people had “mad accents” and were wearing balaclavas. 

“They weren’t from around here,” he added, “It was London or something.”

When asked how he knew about the accents, he replied: “When they were shouting, ‘You’re f***ing dead’.”

He told the trial: “There were three people that got out of the Mercedes. They smashed the front windows of Amy’s car. I jumped back into the car. 

“All three of them who jumped out definitely had something in their hands

“There were three people standing in front of me with machetes or hammers. It was either fight or flight. 

“We looked at each other and said ‘we need to get out of here’.”

Amy Rose’s boyfriend was giving evidence on the third day of proceedings against the four men.

On Tuesday, he told Mr Cameron that Amy Rose had driven away from Foundry Street following the incident. 

He said that the Mercedes car started following her and, a short distance later, came into contact with the back of the vehicle. 

Speaking about the Mercedes, he said: “It was actually ramming into her car. I was scared, to be honest. 

“Once they crashed into us, I blacked out and woke up in hospital. I can’t remember anything else.”

He said there were three dogs in the car at the time – he said one of the dogs was an XL Bully, and another was a German Shepherd. He said one of the dogs died following the collision. 

Describing his own injuries, the man said he had a bleed on his brain and a punctured lung.

He told jurors that he suffered a “mental breakdown” and has post-traumatic stress disorder, anxiety and depression. 

He added: “I can’t remember anything. I can’t remember what I had for my lunch yesterday.”

Prosecutors allege that on “various occasions between May 1, 2023, and July 29, 2023” at locations across the UK, Sajid and his three co-accused conspired with each other to assault and rob persons of a quantity of controlled drugs and money. 

The charge states that “in pursuance” of the “conspiracy” the four men communicated with each other for “the purpose of discussing and planning assault and robbery, source and obtain gloves, hammers, bladed instruments and vehicle registered KM 58 TPU.”

They are said to have done these things “all for the intended use in assault and robbery”. 

The charge states that “having acquired knowledge that an illicit controlled drugs transaction was to take place at Westway retail park, Cumbernauld” they travelled from the south east of England to Scotland in two vehicles ahead of the alleged attack.

The trial, before judge Lady Drummond, continues.
