Farmer, 87, killed after being struck by cow in Aberdeenshire 'could have waited for assistance'

An experienced farmer who died after being struck by a cow in Stonehaven “could have waited for assistance”.

A fatal accident inquiry heard that cattle were being moved onto a lorry to be transported for slaughter at Ferniebrae Farm in June 16 last year, when one of the cows turned and ran towards David Ewan.

The 87-year-old was taken to Aberdeen Royal Infirmary after the incident, but could not be saved and died that evening.

His cause of death was listed as a traumatic brain injury and rib fractures.

In his written determination, Sheriff Ian Wallace said the farmer could have waited for his daughter and a lorry driver, who were on their way, to carry out the task.

The 87-year-old’s health was said to have deteriorated and his mobility had decreased, placing him at “greater risk” of injury when handling the animals.

Following the publication of the determination, Procurator Fiscal Andy Shanks for the Crown Office and Procurator Fiscal Service, Scotland’s independent deaths investigation authority, said: “The Sheriff’s Determination highlights the importance of assessing the risks associated with cattle handling, particularly for older farmers.

“Cattle can behave unpredictably and even routine tasks can have tragic consequences.

“Farmers should consider this tragic case as an opportunity to review livestock handling arrangements.”

‘The farm was his life and hobby’

The sheriff described Mr Ewan as a man who would not ask for help, but was grateful for all the help that he did receive.

He grew up on a farm and had been a farmer all his working life.

The sheriff added: “For the previous 20 years, Mr Ewan had been saying that he would retire the next year, but he never did. The farm was his life and his hobby.

“Family members attended every hearing. All of this speaks to the love and affection they held, and still hold, for Mr Ewan.

“Ferniebrae Farm no longer houses any cattle. The family do not intend keeping the farm running, and are planning to sell it.

“In these circumstances, there are no recommendations to be made.

“Our thoughts are with Mr Ewan’s family at this time.”
