Man raped ill woman after she asked for childcare help

A man who raped an ill woman after she asked him to stay over and help with child care has been jailed.

Damian Collier left the victim crying with pain during the assault after he ignored her plea to stop.

A friend later found the woman looking “awful” at her home in Aberdeenshire and the upset victim disclosed that she had been raped.

She later contacted police and 29-year-old Collier was detained, but claimed he hadn’t done anything.

After an initial court appearance he was given bail but that night told a support worker: “I’m not going to lie to you, I did do it.

“I had absolutely no intention of doing that to her and I feel really guilty.”

Collier, of Fraserburgh, Aberdeenshire, admitted raping the woman on an occasion between January 3 and 12 this year, when he appeared at the High Court in Edinburgh.

Advocate depute Jane Farquharson QC told the court that the woman had asked Collier to help care for a child.

The prosecutor said: “She was not feeling well, suffering a flu-like virus.

“On the night in question the complainer retired to her bed early as she was not feeling well. She describes having a high temperature and feeling hot.”

Collier put the child to bed but then got into the woman’s bed. She asked to be left alone and rejected his advances.

He began carrying out a sex act on her and she asked him to stop and began to cry in pain.

Collier continued to rape her as she became more and more upset. She told him: “I don’t f****** want this. It is hurting, stop.”

The woman pushed him off afterwards and shouted at him: “Do you realise what you have just done?”

Collier later made a series of admissions to friends one of which was recorded on a mobile phone without his knowing.

Ms Farquharson said: “He can be heard explaining; ‘I didn’t go down there with the intention of raping her. Trust me I didn’t. I can’t express how sorry I am for what I did.'”

The court heard that Collier has offended before but has never previously received a prison sentence.

Defence counsel Gareth Jones told the court that he was not instructed to seek bail for Collier who was remanded in custody following his guilty plea.

Judge Norman McFadyen called for a background report, including a risk assessment, to be prepared on him ahead of sentencing later this month.
Collier was placed on the sex offenders’ register.
